Last night at City Council you saw corruption at its finest. A man (Eddie Aviles) alleged that the Allentown Police assualted him and called him a "f_c_k__g fa_got" while in their custody.
Eddie is obviously targeted by the police. He is very outspoken. He was visibly angry and told council he wanted the investigation results since he filed a Right to Know request and a Act 22 request (for body camera footage). He stated he has followed the rules the city told him and he has been denied any information.
Another male who stated he was "gay" was appalled by the fact he tried to get the findings of the investigation as well and was denied.
This appears to be a total coverup by Chief Roca and the Mayors office. Once again, the APD is covering up allegations of misconduct of one of their own. Big surprise. If the investigation is over is, YOU have to by law give over the findings. Council, the solicitor’s office, nor the Police Chief are above the law.
The city is afraid to release any information for fear of the news backlash that will occur if in fact these allegations are true. I hope Eddie gets an attorney, and has a judge order the release of the body cameras.
The city boasts transparency and Chief Roca is always saying he wants to build trust within the community. Bullshit. Bullshit Bullshit.
This blog has stated before that this city council chooses to violate case law and the Sunshine Act by trying to limit the rights to free speech. They have created a list of rules that essentially stifle the right to free speech and hide it under the auspices of “decorum”.
Although no one wants to be publicly criticized it is part of being an elected official. In PA citizens have the absolute right to publicly criticize, challenge, and even harshly berate council during public comment. The council cannot shut down speech simply because it is rude, insulting, or uncomfortable. That is at the very center of the First Amendment.
The federal courts have repeatedly held that public comment at any government meeting is a designated public forum, and free speech cannot be restricted based on viewpoint. City officials may only regulate time, place, and manner….NOT content.
Quit crying because someone is calling you out.
There are exceptions and based on the gentleman’s comments last night they do not appear to apply. Here are the exceptions since council needs to be taught the rules.
Threats
Incitement to imminent lawless action
Actual disruption (refusal to yield the floor, shouting in audience and disrupting official business)
Being disrespectful, sarcastic, angry, or accusatory is not illegal and cannot be prohibited.

Should be noted: We often wonder where our tax dollars go, and last night, we had a chance to see wasted money in action. The council has upgraded its camera and broadcasting system to a high-definition modern system. It should be noted that this cost the taxpayers $270,329.42. Over a quarter million to upgrade the council camera systems!!!! That is absurd. Someone should look into that vendor and their connections. However, with the added HD we can now see what Verizon Frank is dreaming about during his council naps. see R56 at the link below:

Big Brother is always watching. If it is not a Flock camera system reading your license plate and watching your every move, it is a new camera system at public meetings. And Allentown wants to approve data centers to store this type of data?
Now to Council President Napoli.
What a display of weak leadership all around by Council President Napoli. Unfortunately he lost complete control of the meeting and allowed an angry citizen to be further angered to the point that name calling and insults occurred. Napoli should resign as president for his weak and failed leadership—clearly a top tier understudy of Matt Tuerk’s.
I do not condone the behavior of Mr Aviles but I do support his right to be frustrated with city leaders for their repeated ignoring of the situation that has made him so angry.
The truth is that City Council cannot order the police or city administrators to do anything. They essentially can ask questions and will most likely get the same bullshit answers from the administration. It ends there - they do not have any administrative authority over the APD or employees.
Now the failures in this instance were solely with Napoli for giving Mr Aviles hope at the prior meeting where he said he would get answers after he read a canned statement from the Administration. He caused the anger and frustration to spill into last night’s meeting because of his failure as a leader to follow through and set an expectation for Mr. Aviles.
Napoli by his inaction and disregard of the situation caused the escalation. Mr. Aviles was wrong to scream, yell, and tell council to “shut up”…but the failed approach to handling the situation by the Administration, APD, Legal, and the Council President added fuel to an already burning inferno. No one should be called a “f_cking f_g_ot” by a city employee, especially a law enforcement officer.

Abe. I didn’t know the video was out there. I went to the site last night to watch the meeting and there was no live video. I guess the upgrade is actually a downgrade for those of us who like to watch a live stream of the meeting?
Now that I have watched the video, I must say that it is embarrassing to watch our city leaders continue to fail over and over again.
They fail the city, the citizens and visitors, the pledge to their country and city when taking office, and they fail each other.
I agree with you that Mr Napoli is weak, but he is not alone. It seems to me that Mr Aviles continues to have run ins with law enforcement and they have zero respect for him. The disrespect is further exacerbated and allowed by the leaders of this city. They created this anger and seem to promote its existence. I do not doubt those words were said to Mr Aviles. The city should be ashamed of their failure to swiftly handle the situation and respond respectfully to Mr Aviles. The officer should have been fired immediately.
Eddie. Calls it like it is. Council, never has answers and wonder why people get pissed.
Hey! What has happened to Mr
LGBTQIA+ 2022-2026, Matt Tuerk? He has been silent—is he still the mayor?
I would think he would be out there demanding justice for Eddie and promising to punish the officer for using such derogatory statements?
…. Or is this just another exposure of his fake carefully crafted persona? Proving once again that what he says publicly is not at all how he feels in private?
Where is the DEI Manager on this? Has Ms. Ghafoor-Davis reached out to Eddie? Is she even at work?
Vote red! Get These demon rats out of office
At this point, I don’t even think they know what they’re voting on. They passed a bill last night allowing APD officers to buy back up to 5 years of previous service time. Candida then started babbling about how we are down so many officers that this will be a great help. Then Frank said he had no idea how many cops are eligible, but that 10 already applied for it. Hey Candida, that means that 10 officers are leaving up to 5 years earlier than they would have! How does that help how many cops we have. Once again, wasn’t Roca and the FOP just saying they need the DROP because retention is an issue? Then they turn around and go “hey, if anyone wants to leave early, here’s a great incentive”. It’s not a recruiting tool at all, most good cops don’t leave their nice departments after 5 years to go to a city force, it’s usually the opposite.
Affa triggered him. She interrupted him and told him to keep her name out of his mouth. She was the start of the dysfunction and Napoli was way out of his league tonight. . They are all disgraceful for remaining silent while APD officers are calling people such heinous names. The entire council is worthless.
Again, they are all incompetent and don’t even know what they are talking about.
They have a script they read to sound like they know what they’re saying—probably written by another council member or the clerk.
Cece Gerlach wants to be elected to PA State government? God help the Lehigh Valley if she is elected.
I assume the upgrade of City Council cameras applies just to equipment found inside the City Council Chamber. If so, the amount being spent is probably twice the amount of money actually needed. Was it put open to vendors to bid?
Council should ask for Napoli’s resignation as president. And while they’re at it do a vote of no confidence on themselves and the administration..
Cece is a communist, just like Tuerk
Perfectly said Abe!
Truth. Someone is writing their comments. Suddenly Mota knows what she is talking about after all of these years? (As she reads from a paper)
To me this is a classic dumb and dumber situation, Eddie is a shameless self promoter who will do anything for attention. Last night was nothing more than an example of that. I don't think his comments are worthy of a grain of sand, however, when this sort of character meets the dim and dimmer characters on our council the results are predictable. Council and council chambers have been a freak show for some time now, one is left to only ponder which side of the dias is worse.
OK your gay now go away and shut up no one cares.
"Another male who stated he was 'gay' was appalled by the fact he tried to get the findings of the investigation as well and was denied."
I am requesting relief from the Court on the basis that I'm gay.
I appreciate your comments but I would point out that there are many shameless self promoters that come to council chambers with an issue they are currently passionate about and exploit it to say the city administration isn't doing enough for their cause. They are handed grant money from the city and you never see them again…at least until funds get low.
Who Eddie is, or who you feel he is, really doesn’t matter. He was called a term that has right coming out of public servants mouth. He deserves to have his questions answered and for their to be discipline greater than a slap on the hand. The situation wreaks of a cover-up.
I think if the shoe was on the other foot anyone in this situation would also want answers from their government.
Did you hear the "public servant " say it? Are you just taking his word on it that a public servant said? Really? Is it likely that a public servant would do such as thing here in Allentown where any such remark would get you immediately fired and make it nearly impossible to be hired for a similar position anywhere else? Say what you want about the chief, but by what logic would he try to cover up such a claim when it is clear there would be no upside for him for doing so. Finally, Allentown seems to to have an over abundance of very credulous people. Not all of them are in city government. That's just one of our many problems.
Honestly, if you care about this kind of thing you probably are a faggot.
Great list of case law Abe. Let's see how Mr. Napoli handles Eddie next time. Mota is a joke.
Actually, I can add to this because I was there and heard it said. In this situation, Eddie is being truthful and deserves answers.
This is what Allentown has become under the Tuerk Administration. Keep voting for people based on the party they are affiliated and not their actual competence.
Where’s the Mayor in all this??
Chief covers up everything that is wrong with the department. Remember vice officers? His ego is way bigger than his head.
On Expedia.com with his city credit card.
The DEI manager is absent most of the time. She can’t get to work on time and is unable to put in a full day, let alone week. Her boss is the HR Director and he is working from home most of the time.
Probably because he is afraid his lack of HR education will finally be exposed.
This whole problem rests solely on Mayor McPronouns. He is the king of identity based politics. Even IF the police called Eddie a bad name, so what? I mean the big mean man said bad words to you so you come unglued about it? Please. Those with their greatest accomplishments being their "identity" are super irritating. Identity over competency incubates a victim culture that is perpetually outraged and ready to get spun up at the most insignificant nothingburger and treat it likes it's a really big deal. Like ebola big.
The electards are looked upon by the population as "leaders" who set the tone for oh I don't know things like tangible successes and enumerated accomplishments. McPronouns has none of these so the population responds in kind.
But this critique falls upon ears deafened by the self-assurance that McPronouns knows better than us regular mouth breathers who pay the taxes and fees that fund his expedia driven lust to venture out into the world and "sell" Allentown. Stop selling and start leading. Make Allentown less of a third world shithole and it will sell itself. And tell Eddie to go jump in the river and stop worrying about mean words allegedly said by police. This is yet another attempt to get a lawsuit settled for bank.
The fat girl with the eyebrows in HR is always out too. Seems to be the standard throughout the department
City employees feel same discrimination from the NEW CITY MANAGEMENT!! These people are hardly on job less that 5 yrs and there manger of departments. Employees file complaints but nothing ever happens?? Can’t get positive rulings from HR , so I guess it’s dropped. This whole city management team is joke ! Thank God nothing really bad happens bc they won’t have clue on how to respond!! Just wait winter is coming!!!
